General conditions.

These general conditions apply solely and exclusively to the website owned by Gerontalia, by USERS who access it. These general conditions are displayed to the USER on the website, on each and every page and each time a USER enters their data in the existing forms, so that they can read, print, file and accept them via the Internet, and the USER cannot effectively enter their data without this acceptance having taken place.

Access to the TIERRA DE ORO website implies unreserved acceptance of these general conditions of use, which the USER states that he/she fully understands. The USER undertakes not to use the website and the services offered on it to carry out activities contrary to the law and to respect these general conditions at all times.

I.- Introduction.​

This document has been drawn up in accordance with and in compliance with the provisions of Organic Law 3/2018 of 5 December 2018 on the Protection of Personal Data and Guarantee of Digital Rights and Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce.

Likewise, its purpose is to establish and regulate the rules of use of the Portal http://tierradeoro.es (hereinafter the ‘Portal’), understanding by Portal all the pages and their contents owned by Gerontalia S.L. (hereinafter Gerontalia) which are accessed through the domain http://tierradeoro.es (and its subdomains).

The use of the Portal confers the condition of User of the Portal (hereinafter User) and implies the acceptance of all the conditions included in this Legal Notice, and the user must read this notice carefully if he/she intends to use the Portal.

II.- Ownership of the Web Portal.

III.- Intellectual and industrial property.

The User acknowledges that all the contents of the website and, specifically, all the information and materials, the structure, selection, arrangement and provision of its contents, service or product, programmes and development of applications used in relation to them, are protected by intellectual and industrial property rights owned by the owner of the website or, where appropriate, by third parties.

Under no circumstances shall access to them or their use by the User imply any kind of waiver, transmission or total or partial transfer of said rights, nor confer any right of use, alteration, exploitation, reproduction, distribution or public communication of said contents without the prior and express authorisation specifically granted for this purpose by GERONTALIA or by the third party holder of the rights affected.

ARAL is the owner of the elements that make up the graphic design of its website, the menus, navigation buttons, code, texts, images, textures, graphics and any other content of the website or, in other cases, has the corresponding authorisation for the use of said elements.

All trademarks, trade names or distinctive signs shown on this page are the property of GERONTALIA and/or third party companies. It is forbidden to use them or permanently download, copy or distribute them by any means without the mandatory consent of their owner.

Similarly, the User accepts that access to this Internet Service shall not be understood as a tacit concession, by virtue of the doctrine of the acts themselves or by any other mechanism, of any licence or right to use any trademark, trade name or any other distinctive sign appearing on this Portal, without the prior written consent of GERONTALIA or its respective owners.

IV.- Responsibilities.

The User shall be liable for damages of any kind which GERONTALIA or any third party may suffer as a consequence of the non-fulfilment of any of the obligations to which he is subject by these General Conditions.

GERONTALIA does not assume any responsibility nor does it have any control over the possible hyperlinks contained in the web to external contents; nevertheless, it will remove those links that include illicit contents as soon as it becomes aware of them.

Access to the Portal does not imply any obligation on the part of GERONTALIA to control the absence of viruses or any other harmful computer element, and the User shall be responsible for the availability of adequate tools for the detection and disinfection of harmful computer programmes, and GERONTALIA shall not be held responsible for any damage caused to the computer equipment of the Users or of third parties during the provision of the service of the Portal.

GERONTALIA shall not be liable for any damage or loss caused to the User as a result of faults or disconnections in the telecommunications networks which lead to the suspension, cancellation or interruption of the service of the Portal during the provision of the same or prior or subsequent to the same.

V.- Applicable law and jurisdiction.

The relationship between GERONTALIA S.L. and the USER shall be governed by the Spanish regulations in force and any controversy shall be submitted to the Courts and Tribunals of the city of Santa Cruz de Tenerife.
